TallyScout — Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you") and WBS, a sole trader of England, United Kingdom ("Tallyscout", "we", "us"). By creating an account or using the Tallyscout app (the "Service") you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Tallyscout is an iOS application that lets you scan product barcodes, record prices across stores, maintain shopping lists, and view per-product price history. The Service is provided on an iOS-first basis and may evolve over time.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm a parent or guardian has reviewed these Terms on your behalf. We may refuse or terminate accounts that do not meet this requirement.

5. Subscriptions and Billing

Tallyscout offers a free tier and one or more paid subscriptions sold through the Apple App Store. Auto-renewal, cancellation, refunds, free trial, price changes, and Family Sharing are governed by our separate Purchase Terms, available at [tallyscout.app/purchase-terms](https://tallyscout.app/purchase-terms), which form part of these Terms by reference.

In short: subscriptions auto-renew at the same price each period until you cancel, cancellation is managed through your Apple Account, and refunds are handled by Apple. Your statutory rights as a consumer under the UK Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015 are unaffected.

6. Your Content

You retain ownership of the data you create in the Service (shopping lists, trip history, product photos, etc.) ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, process, and display Your Content to operate and improve the Service for you.

We may also produce aggregated and anonymised datasets derived from Your Content and other users' content (for example, average prices of products by region or category). Aggregated and anonymised data cannot be linked back to you and is no longer your personal data. We may use, publish, or commercialise such datasets, including selling or licensing them to third parties. We will not sell data that personally identifies you without your separate, explicit consent.

You are responsible for the legality of Your Content and that you have the rights to upload it (including any product photos).

7. Third-Party Data and Services

Product information (names, brands, nutrition data, images) is sourced from third parties, including Open Food Facts and Open Library, and may be incomplete, outdated, or inaccurate. We make no warranty as to product, pricing, or nutritional accuracy. You must verify critical information (allergens, ingredients, prices) at the point of purchase. A list of data sources and their licences is available in the app under _Settings → About → Acknowledgements_.

The Service relies on third-party processors (including Apple, RevenueCat, Supabase, Cloudflare, Sentry, and PostHog). Their handling of your personal data is described in our Privacy Policy.

8. Intellectual Property

The Tallyscout app, its name, branding, code, and design are owned by us and protected by intellectual-property laws. Except as expressly granted in these Terms, no licence is given to copy, modify, or redistribute the Service.

9. Bot Protection

We use Cloudflare Turnstile (including invisible challenges) and similar mechanisms to detect automated abuse. By using the Service you consent to the collection of device and request signals required for these checks. Details are in our Privacy Policy.

10. Termination and Account Deletion

You may delete your account at any time from in-app settings or by emailing support@tallyscout.app. On deletion:

11. Disclaimers

The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that any data (especially prices, nutrition, or product information) is accurate or current. Offline features depend on your device's storage and connectivity.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer under English law.

To the maximum extent permitted by law:

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers resident elsewhere in the UK may bring proceedings in their local courts.
